Keadilan Restoratif bagi Anak Pelaku Tindak Pidana yang Dilakukan Bersama Orang Dewasa: Dilema Antara Pembinaan dan Pemidanaan

Artikel ini mengkaji penerapan prinsip keadilan restoratif terhadap anak pelaku tindak pidana yang dilakukan bersama orang dewasa, yang menimbulkan dilema antara pembinaan dan pemidanaan dalam sistem peradilan pidana Indonesia. Melalui pendekatan yuridis normatif dan kualitatif deskriptif, penelitian ini menelaah norma, asas hukum, serta doktrin yang mengatur perlindungan anak dalam konteks hukum pidana. Temuan menunjukkan bahwa sistem hukum Indonesia masih menghadapi tantangan dalam menerapkan prinsip diversi dan keadilan restoratif ketika tindak pidana melibatkan pelaku dewasa. Di satu sisi, negara berkewajiban menegakkan hukum dan memberikan efek jera; di sisi lain, negara juga harus menjamin hak anak untuk dibina dan dilindungi sesuai prinsip the best interest of the child. Oleh karena itu, diperlukan pemisahan perkara antara anak dan pelaku dewasa, serta peningkatan kapasitas aparat penegak hukum dalam menerapkan pendekatan restoratif yang menyeimbangkan kepastian hukum, keadilan, dan kemanusiaan. Penelitian ini menegaskan pentingnya perubahan paradigma penegakan hukum dari orientasi retributif menuju pendekatan restoratif demi mewujudkan sistem peradilan pidana anak yang humanis dan berkeadilan sosial.
